President Alvi signs Pakistan Army Act and Official Secrets (Amendment) Bills

Pakistan Army Act

ISLAMABAD: President Arif Alvi signed the Pakistan Army Act (Amendment) Bill, 2023 and the Official Secrets (Amendment) Bill, 2023 on Saturday.

The parliament passed both bills during the coalition government’s tenure and forwarded them to President Alvi for approval.

The Army Act Bill stipulates that unauthorized disclosure of information will result in severe penalties of up to five years imprisonment.

However, there is no punishment for disclosures with the permission of the Army Chief or an authorized officer.

Furthermore, the bill prohibits army officials from engaging in political activities within two years of retirement, resignation, or dismissal.

Meanwhile, individuals involved in electronic crimes aimed at defaming the Pakistan Army will face prosecution under electronic crime laws.

Official Secrets Act Bill

Regarding the Official Secrets Act Bill, its Statement of Objects and Reasons highlights the necessity to amend the 1923 Official Secrets Act. It will enhance its effectiveness in light of evolving societal dynamics and ensure the safety of official documents.

Section 3 of the bill establishes that individuals commit an offense if they approach, inspect, attack, destroy, or undermine any prohibited place. The section also states that creating sketches, plans, models, or notes with the potential to aid an enemy constitutes an offense.

Additionally, the bill outlines offenses related to obtaining, recording, publishing, or communicating secret official codes, passwords, electronic or modem devices, sketches, or plans intended to assist an enemy of the State.

The amendment to Section 9 introduces penalties for incitement, conspiracy, and attempted offenses. It also involves up to three years in jail and a fine of up to one million, or both.

Furthermore, the bill designates the FIA to handle investigations. In cases where necessary, FIA can form a joint investigation team.

The amendment bill also empowers intelligence agencies to conduct searches at any location and time without warrants.
