Hearing of the Toshakhana case
ISLAMABAD: The Supreme Court of Pakistan and the Islamabad High Court adjourned the hearing of the Toshakhana case on Thursday.
The Chief Justice of Pakistan Bandial adjourned the hearing of the case first. The CJP said that the IHC is hearing the case and the apex court will take up the case once the IHC announces its decision.
The IHC conducted the hearing of the PTI chairman’s plea to suspend his imprisonment. However, after hearing arguments of the PTI chairman’s counsel Sardar Latif Khosa, and ECP’s lawyer Amjad Parvez, the court adjourned the case till Friday.
Hence, the PTI lawyers and supporters who were anticipating a decision in this case today will have to wait for Friday’s hearing of the IHC.
Meanwhile, the Supreme Court is expected to delay the hearing of the case till next week as a member of the three-member bench Justice Mazahar Ali Akbar Naqvi left for Lahore today.
SC takes up for hearing Toshakhana case
Earlier, the Supreme Court of Pakistan takes up for hearing today the lower court’s decision against Imran Khan in the Toshakhana case.
The Additional Sessions and District Judge Humayun Dilawar awarded three years imprisonment to Imran Khan in this case.
Judge Dilawar left for training in the United Kingdom, a day after announcing jail term for PTI chairman Imran Khan.
On Wednesday, the Chief Justice of Pakistan Umar Ata Bandial said the lower court announced the decision in a haste. He also noted flaws in the decision against Imran Khan.
The Supreme Court, however, adjourned the hearing on Wednesday for a day as the Islamabad High Court is hearing the case.
The CJP said that the apex court will hear the case on Thursday.
According to the SC’s Registrar, hearing of the Toshakhana case will resume at 2 pm today.
SC finds flaws in the lower court decision against Khan
Earlier, the Supreme Court of Pakistan identified “flaws” in the judgement of a sessions court against PTI Chief Imran Khan, resulting in his imprisonment. However, the Supreme Court has chosen not to intervene until the next hearing of the case in the high court.
The Supreme Court granted permission to the Islamabad High Court to address the appeal against the sessions court’s judgement. The Supreme Court stated that if no developments occur in the high court, it would issue a verdict.
The Chief Justice of Pakistan, Justice Umar Ata Bandial, led a three-member bench during the proceedings. He remarked that there were apparent “flaws” in the August 5 judgement of Judge Humayun Dilawar.

The Chief Justice emphasized that the trial court’s decision, made within a single day, appeared to have “flaws.” However, the SC opted not to intervene at the moment and decided to let the High Court make a decision.
During the hearing, Chief Justice Umar Ata Bandial expressed frustration with the Election Commission’s lawyer. He questioned the extent of justice provided to Chairman of PTI, Imran Khan.
